“Of course, the FDIC has never paid an atom of gold to any depositor, and was created as part of the gigantic theft and fraud associated with FDR’s gold confiscation. Wikipedia reports that it is still illegal for private citizens to own the gold certificate whose image leads the FDIC propaganda.”

Things like this make it seem more plausible that some of the many conspiracies surrounding the Federal Reserve are true.

Candidate Obama has introduced an array of tax proposals, which he discusses in various places on his campaign website. There are four overlapping themes in the Obama tax proposals the way I see it:

Social engineering.

Discrimination.

Economic micromanagement.

Empty populism.

Under social engineering, I would put Obama’s plan to greatly increase the dependent care tax credit. That would further encourage parents to find institutional day care for their children, rather than providing care themselves.

Under discrimination, I would put Obama’s proposed special tax break for the elderly. The federal fiscal system is already heavily tilted in favor of the elderly, thus it is unclear why Obama would want to further discriminate against the young.

Obama’s “American Opportunity Tax Credit” also creates unfair discrimination. This new tax break for college essentially increases subsidizes for future lawyers, accountants, and other professionals. Why subsidize these folks who will likely have much higher earnings than factory workers, retail clerks, and others who don’t go to college?

Under economic micromanagement, I would put Obama’s Patriot Employer Act, which provides tax breaks to certain businesses that jump through hoops related to hiring, wages, and other items. Obama wants to cut capital gains taxes on certain investments and increase capital gains taxes on others, and he is proposing various narrow energy tax breaks.

Under empty populism, I would put Obama’s railings against “tax haven abuse” and “corporate loopholes.” If Mr. Obama really wanted to reduce corporate tax avoidance–rather than just using it as a campaign prop–he would join with John McCain and call for an across-the-board corporate rate cut.

A final category might be “innocuous tax cuts that do nothing for economic growth.” Here I would put Obama’s $500 payroll tax credit called “making work pay.” If Obama had wanted to spur employment, he should have proposed a cut in the payroll tax rate, which would change the marginal incentive to work, unlike the proposed credit.

In sum, Obama’s tax proposals are pretty awful. It is true that many Republicans and Democrats have proposed similarly bad tax ideas over the years. But Obama can be contrasted with candidate McCain, who thus far has avoided narrow favoritism in his tax proposals, and favors broad-based tax reductions designed to spur economic growth.

This is “change?” Looks like more of the same failed policies and economic ignorance.

Hoping to curb the increase in the number of young people who smoke small, inexpensive cigars, Baltimore plans to bar shops from the common practice of breaking open packages to sell them individually.
Baltimore would be the first city to impose such a regulation, said Dr. Joshua M. Sharfstein, the city’s health commissioner.

The city has put the proposal out for public comment until July 1 and expects to impose the ban, possibly with revisions, soon after, Dr. Sharfstein said. Under the city code, the commissioner has the power to regulate health hazards without legislation.

A ban on selling tobacco products to minors has had limited effect, Dr. Sharfstein said, and studies have shown that higher prices have a larger deterrent effect on youth smoking.

“This isn’t going to work but we’ll do it anyway.”

It’s frightening that the health commissioner has so much power.

Yesterday, the Supreme Court of Texas ruled that Child Protective Services (CPS) abused its discretion by seizing 468 children from the Fundamentalist Church of Latter Day Saints ranch in Eldorado. Eugene Volokh has a roundup of the legal analysis.

CPS invited some mental health workers to the various shelters to help care for the hundreds of children. The mental health workers were disturbed by what they saw of CPS’s treatment of the women and children, and their written reports corroborate the bitter complaints of the FLDS mothers. I don’t think the news media has given this aspect of the story the attention it deserves — so here are some excerpts from the various reports that have been made public:

“Women were constantly lied to about where their children [were] and when they could see their lawyers and about when they would be reunited with their children.”

“Constant reminders that the adult women were only guests and that they were not in charge of the children and what CPS did to them. [The children] belonged to CPS now and they could talk, interrogate, separate and treat them any way [CPS] wanted. This included physical exams and x-rays without [parental] supervision.”

“I sat with Audrey while three of her children were removed for six hours of questioning.”

“The children arrived healthy and happy and left sick and crying.”

“The door to the room was almost constantly open. Even when the women closed the door to reduce noise during naptime or to dress themselves or the children, it was almost immediately opened again [by a CPS worker].”

“The women were lied to and denied access to their attorneys.”

“At least 5 mothers reported that at night CPS [workers] circled their beds, held flashlight in their faces & then would sit inches away from them as they tried to sleep. Mothers reported that they were scared CPS would take their children during the night.”

“The CPS workers were openly rude to the mothers and the children, yelled at them for trying to wave to friends and family members in surrounding shelters, threatened them with arrest if they did not stop waving to others, continually reminded them that the women were guests only and could be made to leave if they did not cooperate, threatened the mothers with never seeing their children again if they did not cooperate, and ignored requests for anything.”

“The children were amazingly clean, happy, healthy, energetic, inquisitive, well behaved, and self-confident; while the mothers were consistently calm, patient, and loving with their children.”

“Living conditions in the coliseum were not conducive to good health for anyone, and the presence of hostile CPS workers who spied on them constantly, kept them awake at night by shining lights in their faces and talking and laughing created enormous stress for the mothers and children. None of them slept well or enough.”

“Try to imagine all these children from age 1 to 12 years, left in that coliseum [separated from their mothers] with only CPS and [police officers] to care for them. The only others were mothers whom CPS decided were under 18 and kept in their custody along with their children. The floor was literally slick with tears in places. A baby was left in a stroller without food and water for 24 hours and ended up in the hospital. A 4 year old boy was so terrified that he snuck away and hid and was only found after the coliseum had been emptied the next day.”

“I witnessed a young mother named Rosinith be required by CPS to board the bus back to the ranch, though her young child was in the hospital with 104 degree fever and even though the child’s physician had personally requested the mother’s presence at the hospital. This event haunts me still, and I cannot imagine such a heartless act.”

“By the second day, I was ready to run in front of the CNN cameras to shout that there was a travesty happening inside those walls…. Of course I was cautioned not to interfere in a ‘crime scene investigation.’”

“I have always been proud to be an American and a Texan but this incident is not what America or Texas stands for and something must be done to undo the horrible injustice that has been done.”

CPS denies the allegations of mistreatment. But the excerpts above are eyewitness reports from objective/disinterested social workers that CPS invited into the shelters.

Justice is still not served. Not until restitution is paid and those who brought this about are punished directly. Now we need the state to return the children kidnapped from Strong City. Jeff Bent, Wayne Bent aka Michael Travesser son, was on Free Talk Live yesterday for those interested.

The state of Texas should not have removed more than 400 children it took from a polygamist sect’s ranch, an appeals court ruled Thursday.

Earlier this year, authorities raided the Yearning for Zion ranch in Eldorado, Texas, after they received reports of child abuse.

About 460 children were taken from the ranch, which is run by the Fundamentalist Church of Jesus Christ of Latter-day Saints, a polygamist sect linked to the jailed “prophet” Warren Steed Jeffs.

Parents have denied the claims of abuse and have been fighting to get their children back.

This is a great turn of events. Just in the past days I’ve heard that another court in Texas hearing some part of this case told the mothers that if they wanted their children back they’d have to repudiate their religion. As I understand it that’s an unforgivable sin, blasphemy. If true that’s absolutely disgusting. Effectively asking them to choose between eternal damnation or their child. In any case this ruling is the first positive thing to come out of this travesty. Hopefully it continues on this new path. Unfortunately even if nothing is ever found likely no one from the State will be held responsible for this. No charges will be brought or if they are nothing will come from it. No restitution. The Nuremberg defense will be used and at worst maybe a reprimand or a bureaucrat or two will loose their job. Nothing however to change the likely pre-existing belief the FLDS had that the modern world was controlled by Satan. They have no doubt now.

It bugs me that as much as the MSM talks about this case they still don’t really mention that the original call was a fake. That the whole operation was completely unfounded. That several if not dozens of the women are over the age of 18 yet kept in custody as children. Likely they prefer to stay with the younger ones but it’s still disgusting.

Update:

Here is the AP version:

A state appellate court has ruled that child welfare officials had no right to seize more than 400 children living at a polygamist sect’s ranch. The Third Court of Appeals in Austin ruled that the grounds for removing the children were “legally and factually insufficient” under Texas law. They did not immediately order the return of the children.

Child welfare officials removed the children on the grounds that the sect pushed underage girls into marriage and sex and trained boys to become future perpetrators.

The appellate court ruled the chaotic hearing held last month did not demonstrate the children were in any immediate danger, the only measure of taking children from their homes without court proceedings.

The federal Bureau of Alcohol, Tobacco, Firearms and Explosives is dumping the “Always Think Forfeiture” motto it’s used for more than a decade to help combat crime.

U.S. Rep. Bill Sali, R-Idaho, and others complained that multipurpose tools engraved with the slogan could be seen as encouragement to seize property, including guns, of law-abiding citizens.

The pocket tools were to be given to federal, state and local law-enforcement agents participating in the agency’s asset forfeiture training programs, as a reminder of one way to disrupt or dismantle criminal organizations.

None of the engraved tools, stored in the agency’s headquarters in Washington, D.C., have so far been distributed. And now they won’t be, at least until the engravings have been removed.

The agency will no longer use the slogan on materials given out during its training programs, said Robert Browning, chief of ATF public affairs in Washington, D.C., adding it was never intended to undermine lawful gun rights.

Sali had said that the ATF “through its engraved motto, sends a message that these rights are secondary to the government’s apparent goal to ‘always’ seek forfeit of private property.”

The tools also included the words “ATF – Asset Forfeiture.”

Sali’s outrage over the customized pocket tools is just the latest incident in which the ATF has been in the crosshairs of Idaho’s gun-rights lawmakers. U.S. Sens. Larry Craig and Mike Crapo placed separate holds on President Bush’s 2007 nomination of federal prosecutor Michael Sullivan to lead the agency, saying the ATF was being too tough with gun dealers, including a Twin Falls shop that was stripped of its license.

The ATF had revoked the gun dealer license at Red’s Trading Post in Twin Falls after record-keeping violations. A U.S. District Court judge then stayed sanctions after finding the agency had record-keeping problems of its own. That case is ongoing. Sullivan still hasn’t been confirmed to lead the ATF.

By law, the agency can seize firearms, ammunition, explosives, alcohol, tobacco, money and certain real property if such items are involved in breaking the law. Federal, state and local law enforcement agencies rely on asset forfeiture to break up criminal activity, on the contention some groups would continue to operate if the only thing officers could do was lock some leaders in prison.

ATF has used the “Always Think Forfeiture” slogan for more than a decade on materials for training classes it conducts across the United States to increase awareness for officers about forfeiture laws. This is the first time a complaint has been lodged, the agency said.

“We’ve had it brought to our attention from several different congressional members,” Browning said. “In hindsight, we certainly would not have used this slogan if we knew that it would cause so much concern among the public. Nothing in this program is intended to deprive the rights of law-abiding gun owners.”

Sali, who said a constituent brought the engraved tools to his attention, said he’s drafting legislation to prevent the agency from using similar slogans in future training campaigns.

“I’d hate to put a time on it,” Sali spokesman Wayne Hoffman said of the proposed bill. “It’s something we just started. It’s one of the congressman’s priorities.”

It’s a nice gesture but it’s not like they will stop using asset forfeiture just because they stop using the slogan. These people are above the law and will continue to steal from people as they desire.

Like how they make it out to be that primarily it’s gun owners effected by this? That means a good portion of the public who are anti-gun won’t pick up on the seriousness of this “tool.” Though if we throw in this story I’d bet those same people would get a bit upset but then the anti-immigrant, pro drug war crowd wouldn’t care.

LONG BRANCH – Members of the Marine Terrace, Ocean Terrace, Seaview Avenue Alliance will join attorneys Wednesday in Trenton in the next skirmish of their years-long battle to remain in their homes, which Long Branch is trying to acquire through eminent domain.

Homeowner Louis T. Anzalone will be 91 at the end of the month. His wife, Lillian, already is 91, and they are the most senior residents of their oceanfront neighborhood. They will fight on, despite their hope that their twilight years would be spent differently.

“Everything depends on what these clowns are going to do to us,” said the plain-spoken Anzalone. “I’m just thinking of what our lives are going to be involved in. At 91, how many more years do I have? I wanted to have a little bit of peace at this age.”

The Anzalones will be in the courtroom Wednesday.

“It is an atrocity what they are doing,” he said of the forces that support eminent domain.

Mayor Adam Schneider, who has been demonized by eminent domain opponents, said his position is unchanged since the city decided to acquire the homes in the MTOTSA section for the second phase of Beachfront North, a proposed luxury condominium community.

Rich people want a beach front view, politicians want more tax money and have developer friends so those who have owned their property for years have it designated as blight by the town and taken from them at the threat of violence. Too bad after Kelo v. New London this really can’t be labeled “abuse” of eminent domain but expected behavior.

http://arstechnica.com/…

The US last week released its 2007 wiretapping stats, and they show that such surveillance is up a full 20 percent over the year before. The number of non-secret wiretaps is higher than it has ever been in the last decade, and not a single application was denied in all of 2007. If you’re concerned about privacy, though, the report makes clear that you’re statistically unlikely to be targeted unless you use a cell phone to run drugs. Murder might also earn you a wiretap, but apart from that, the authorities don’t seem to use wiretaps in all but unusual cases.

2,208 wiretaps were requested last year, up from 1,839 the year before, and the vast majority of them were run by state authorities; only 457 wiretaps were executed by the feds. No applications for wiretap were denied, but this is hardly uncommon. Since 1997, some 15,000 wiretaps have been made, but only four applications were rejected in that entire time.

When we look at the prevalence of wiretaps, two trends stand out. One is that taps are almost exclusively used on “portable devices,” including digital pagers and portable phones. In fact, 94 percent of all taps authorized last year were for such devices. The second trend is that most wiretaps are used in narcotics cases. 81 percent of all taps were for drug-related crime, with murder and assault coming in a distant second (6 percent).

Wiretaps apparently have something in common with shopping at bulk retailers; when you buy more items at once, the price goes down. The cost per intercept has been dropping since 2003, when it peaked at $62,164. In 2007, that number had fallen to $48,477 per investigation. While that still sounds pricey, the report notes that drug intercepts have often been used to make big busts. One set of 2007 wiretaps in Morris County, New Jersey led to the arrest of 105 people; another, in New York, scooped up 51 people, 48 of whom were later convicted. Another 57-day wiretap in California led to the seizure of 40 pounds of methamphetamine, four kilograms of cocaine, and $700,000 in cash.Of course, those are just regular warrants. The Justice Department also released information this week on secret warrants issued by the Foreign Intelligence Surveillance Court. These numbers are also rising, and have been going up since 2001; the increase is a dramatic one. In 2001, the Court approved only 1,012 applications, but approved 2,370 last year.

I’m glad the government is getting a better rate at which to waste our money on rights infringement. Is it likely that these larger drug busts got guys who were actually harming people? Yes, but those people should be arrested for that harm and not providing a drug to another individual in a completely consensual act. This war on drugs is a war on the public. It’s a negative sum game. A drug addiction is a personal problem, a family problem, a community problem. It’s a medical problem. It should be treated as such. In the least I’d like to see some consistency. Alcohol and tobacco are the precursor to far more harm then marijuana or LSD.

And as for the privacy invasion. Wasn’t all this FISA enhancement requested for terrorism? Why are we catching NY governors paying for sex and people selling goods?

…or “How I spent my Saturday night”

In any case, a whole boatload of the Po-Po got together and ran gang interdictions, traffic saturations, drug sweeps, fugitive searches, and some other things I can’t tell you about for a 24 hour period.

It was fun. More about it here.

On the serious side, we now know the mid-south agencies can work together and bring a LOT of police presence and firepower down on a given area if we ever need to do it in a hurry.

Here is a list of agencies involved courtesy of the Shelby County Sheriff’s Web site:

Follow the link to see the huge list of agencies. Check out the comments:

Thank you for the work you do! I’m a Memphis native, relative of former MPD officers, and worked in law enforcement myself. I really enjoy reading your blog. My entire family still lives in Memphis and I go home as often as I can. It’s sad to see what’s become of my hometown. You guys are to be commended for the hard work you put in. Love your commentary!!!

Scary.

FBI raids, Arabs whine, liberal media listens…

There are a couple of stories this weekend on two separate Memphis TV stations (WREG and WHBQ) about some FBI raids on local businesses last week. Both stories center on the poor Arabs who are being harassed by the big, bad Feds. The TV reporters seem really ticked off the FBI didn’t bother to call the TV stations personally and let them know all the facts of the case and exactly when the raids were going to take place…how DARE law enforcement do something without telling the TV news departments? This would be funny except for the fact that the public buys this biased crap.

The stations ran different angles on the same basic story, but the common thread was that the FBI is harassing Arab-owned businessmen and employees. So, in the interest of balance (not to mention those fact thingies), Memphis, ETC would like to share some general facts about middle eastern businesses, terrorism, and the reality of it all.

I wasn’t in on these raids, but we’ve done some in the past. The FBI is always armed with a search warrant, which makes the raids totally legal. Most federal judges won’t sign a search warrant without some really compelling evidence that something criminal is afoot. Apparently that was the case here as well.

To the citizens with their heads buried in the sand, let me state another fact. Terrorists and those who support them are living right here in the Mid-South. They are 99% middle eastern. You may try to spin that, or ignore that fact, but that IS a fact. They are using our laws and our society’s political correctness to skirt the law and fund operations that directly threaten the security of the United States. You may not like that fact, but again, it IS a fact.

Yes, it looks like the FBI did raid Arab owned businesses. Well, last I heard, there were no Canadian, Native Americans, or any other ethnic group besides the Arabs trying to explode a nuclear device in our country. Plus, it’s a funny thing about police work…you follow the evidence in anti-terrorism ops and it just seems to lead to middle eastern folks. Gee, I wonder why?

One of the stories also made mention of the fact that there were some odd items seized in the raid, such as ball caps and jewelry. Well, that may be odd to some Cub reporter who doesn’t care about getting both sides of the story, but that was the bit of information that made the light go off in my head.

I believe the FBI is on to some Arabs running these little corner grocery stores you see that offer all sorts of things besides groceries…you know, CD’s, DVD’s, clothing, jewelry. I’ll bet you my stock in Halliburton this particular case is about counterfeiting and media piracy. Plus, I’d further bet that the FBI thinks funds from these illegal sales are being funneled back to whatever county these jerks are from to fund terrorist operations.

Here’s how it works: Mohammad opens a little store usually in the poorer sections of town. Oh, by the way, your governments lets these folks do this and not pay taxes for 7 years to encourage new small businesses…but guess what? Mohammad has a huge family over here, and at the end of seven years he just sells the business to his brother. Gee, another 7 years of tax-free operations, courtesy of the U.S government. Mohammad sells DVD’s and CD’s cheaper than Wal-Mart, because Mohammad has a $10,000 DVD duplicator in his back room where he is duplicating these movies and CD’s. He sells in the black communities and poorer sections of town because he knows no one will report it because they don’t care. Mohammad is also in the market for stolen cell phones which he can wipe and sell overseas. Since Mohammad pays no taxes, he can afford to send a large amount of his profits back to Yemen, Iran, or wherever…where the money is funneled to the same organizations trying to kill out sons , daughters, moms and dads in Iraq. But in this case this week, the FBI seems to have gotten wind of the operations, and the big bad Feds busted in and took Mohammad’s computers and duplicating equipment, his business records, and some of his counterfeit stuff for evidence. So, Mohammad goes crying to the liberal media which happily gives him a stage for his predictable “They are profiling me” whine, and the liberals just drink that stuff up like it was a Starbuck’s latte’.

I am constantly amazed at the willing suspension of disbelief a lot of Americas have about terrorists operating in American, right now, in YOUR neighborhood. Chances are you’ve bought stuff from them. Even more amazing is that the news media takes a passing glance (maybe) at these stories when actual terrorist are caught…like the University of Memphis Arab student who just happened to have a pilot’s uniform, airport layout diagrams, and books on how to fly planes and act like a pilot (plus all his Muslim jihadist propaganda) in his car.

Wake up, people….

Just because it’s legal doesn’t make it right. Is this guy going to go justifying what Mao, Stalin, Hitler, etc. did because it was all “legal.” And what was the results from those raids? Where any of them convicted on anything related to terrorism or even the dubious “sponsor of terrorism?” Where are these Arabs who are bringing in nukes? What’s the delivery mechanism? Prove to me that this isn’t bigoted propaganda used to bring about a police state?
