Citing a federal regulation that dates to 1957, agents of the Federal Protective Service gave Mr. Musumeci a summons as he recorded a man who was handing pamphlets to potential jurors. The <a title="More articles about New York Civil Liberties Union" href="http://topics.nytimes.com/top/reference/timestopics/organizations/n/new_york_civil_liberties_union/index.html?inline=nyt-org">New York Civil Liberties Union</a> has filed a lawsuit on Mr. Musumeci’s behalf, arguing that the rules that govern photography on federal property were vague and unconstitutional. The lawsuit says people routinely take pictures on the plaza after new citizens are sworn in at the courthouse.</p></blockquote>
<p>Good to see this and related stories continue to make the news.</p>

<p><strong> 1. Purpose of this memo</strong></p>
<p>Here are my thoughts on the state of the nation and possible future plans for our movement. I am requesting your input on these ideas. Please let me know your thoughts.</p>
<p><strong> 2. Government failure</strong></p>
<p>We have a huge prison population, huge debt, huge unemployment, unsuccessful lengthy wars, and bad foreign policy.</p>
<p>We are the number one prison state in the world. With less than 5% of the world’s population, we have 25% of the world’s prisoners. We are filling our prisons with people who own plants, vegetables, and flowers. Our prisons are hellholes.</p>
<p>We are in an economic collapse. The government gave over $1 trillion to the people responsible for the collapse. The government continues to pass legislation that cannot be financed. Our national debt is $13 trillion (about 90% of GDP and growing). The unemployment rate is at 9%.</p>
<p>Our government failed to cope with the environmental disasters caused by hurricane Katrina in New Orleans and the Gulf of Mexico oil spill by British Petroleum.</p>
<p>We are engaged in two lengthy and costly wars. We are sending our young adults to Iraq and Afghanistan to be killed, thus saving Osama Bin Laden the inconvenience of having to come to the U. S. for the killing. Our troops are demoralized because we are not supporting them sufficiently. In Iraq there have been more military deaths from suicide than from military action.</p>
<p>Our foreign policy is insane. We are catering to our enemies (Iran in particular) and alienating our allies. Israel is our staunchest and most reliable ally.</p>
<p>It is the frontline defense against Islamic expansion into Europe. However the Obama administration is going out of its way to alienate the Israelis. Turkey is a member of NATO and was the only Islamic country on good terms with Israel. It has now turned away from us and is siding with the other Islamic countries against us. It was responsible for the attempt to break Israel’s blockade of Gaza. North Korea and Iran snub their noses at us.<br />
<span id="more-5336"></span><strong> 3. Judicial failure</strong></p>
<p>Our courts are no longer courts of law, but are courts of inquisition. They openly ignore our Constitution. In my own experience with the courts, the U. S. District Court of the Southern District of New York denied me a trial and found judgment against me based on “irrefutable” video evidence which was tampered by the police. It disagrees with the police deposition of the facts.</p>
<p>The courts are prosecuting me for exercising my First Amendment right of free speech and my Fifth Amendment right to remain silent. The Sixth Amendment to the U. S. Constitution states:</p>
<blockquote><p>“In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed;”</p></blockquote>
<p>However the federal prosecutor wants to deny me a jury trial for distribution of pamphlets outside the U.S. District Court for the Southern District of New York. Furthermore the court hearing for my arrest in Springfield, MA, has been assigned to the U. S. District Court in Boston, MA. I wonder why it was not assigned to Hawaii or Alaska to inconvenience me further.</p>
<p><strong> 4. Political failure</strong></p>
<p>The general population has given up on the government. Only about 30% of eligible voters actually vote. New political parties are forming or growing. The Tea Party movement of the last couple of years is an indicator of this. Also the Libertarian and other minor parties are growing in membership, as are anarchist groups.</p>
<p>In addition completely alienated groups are being formed and growing. The Southern Poverty Law Center (SPLC) monitors these groups. There are now 932 of these groups in the U. S. Approximately 1/4 of these groups hate ethnic groups, approximately 1/4 oppose illegal immigrants, and approximately 1/2 are<br />
Patriot groups. According to the SPLC:</p>
<blockquote><p>“The number of hate groups in America has been going up for years, rising 54% between 2000 and 2008 and driven largely by an angry backlash against non-white immigration and, starting in the last year of that period, the economic meltdown and the climb to power of an African American president.“</p></blockquote>
<p>But last year, as noted in the SPLC’s August report:</p>
<blockquote><p>&#8220;The Second Wave: Return of the Militias,&#8221; a dramatic resurgence in the Patriot movement and its paramilitary wing, the militias, began. Now, the latest SPLC count finds that an astonishing 363 new Patriot groups appeared in 2009, with the totals going from 149 groups (including 42 militias) to 512 (127 of them militias) — a 244% jump.”</p></blockquote>
<p><strong> 5. Tyranny Fighters program proposals</strong></p>
<p>It is becoming clear that our government has failed us. The American people have given up hope of fixing the problem through the two party system or the courts, at least in the short term. If the economy worsens there will be no long term. Unless something positive is done there will be armed rebellion.</p>
<p>My view is that the best hope to restore freedom is through the juries. That is why I started passing out FIJA information at U. S. District Courthouses and asked you to join in this activity. A few thousand people are active in one way or another. There are 264 on the Tyranny Fighters’ E-mail list. But we must expand our operation. I see two ways to do this:</p>
<ol>
<li>Expand to include other causes and the organizations that support those causes. The constitutional causes that come to mind are:
<ol>
<li>2nd Amendment rights supporting gun ownership. Gun ownership seem to drive some people crazy, because of the excessive reporting of their misuse. However there is no other practical way to hunt or to protect yourself. Guns cause fewer deaths than motor vehicles, swimming pools, cigarettes, alcohol, overeating, or hospital negligence.</li>
<li>End drug prohibition. The current laws violate the right of privacy guaranteed by the 9th Amendment. Putting people in prison for owning plants, vegetables, and flowers is the dumbest thing since the Salem witch trials.</li>
<li>Abolish the income tax, which is robbery and makes criminals of all of us. The worst income tax evaders are illegal immigrants and those involved in selling illegal drugs and prostitution, because these people have no legal income to report. In addition anyone involved in cash transactions or bartering. Income tax evasion is the chief source of monetary crime in the United States.</li>
<li>I believe we should avoid other issues, such as abortion, death penalty, environmental, foreign policy, and immigration. These are important issues, and all of us have strong views on them, but our views are not all the same. Furthermore they are not primarily constitutional issues. These issues will divide us, and we will lose sight of the main goal, which is to regain our freedom. Of course any individual or other group is free to advocate these issues in front of courthouses or anywhere else, even in our presence. We do not oppose free speech for others.</li>
</ol>
</li>
<li>I think that, in addition to FIJA literature, we should distribute literature for the Libertarian and Constitution political parties, as well as for gun rights, abolition of drug prohibition, and abolition of the income tax.</li>
</ol>
<p><strong> 6. FIJA Demonstrations</strong></p>
<p>In addition to the FIJA demonstrations that I am organizing in the northeast, there are demonstrations in several cities in southern Florida organized by Jim Cox, as well as at the county courthouse in Montgomery County, PA organized by the Libertarian Party of PA. I believe that other demonstrations may be occurring in New Hampshire and the San Diego, CA area, but I have no details.</p>

<p><strong>1. Arraignment of July 20, 2010</strong></p>
<p>On July 20, 2010, I appeared at Room 520, U. S. District Courthouse, 500 Pearl Street, New York, NY 10007, as instructed on the notices from the Central Violations Bureau.  A few others were also awaiting arraignments.  I was either the 3rd or 4th person to have his summons papers copied by the clerks.  Others continued to appear continually throughout the morning.  In spite of the fact that I was an early arrival, I was the last person called for a meeting with the federal attorney.  I was called at at 12:00 noon, the last person to be called.  I was taken to a small room to meet with Homeland Security Officer Barnes, the arresting officer, and Santosh Aravind, an Assistant U. S. Attorney for mediation.</p>
<p><span id="more-5332"></span></p>
<p>I was not interested in mediation, so we entered the courtroom about 5 minutes later.  Another arraignment was being finished.  At 12:30 another arraignment was started and adjourned.  Mine was the last case left.  Mr. Aravind asked for a recess until 2:00 pm, because he did not have the paperwork.  Why a U. S. attorney appears at an arraignment without the proper paperwork is not clear to me.  Magistrate Judge Kevin Nathaniel Fox granted the recess until 2:00 pm, and we went to lunch.</p>
<p>I returned at 2:00 pm, as did Officer Barnes with Assistant U. S. Attorney Rebecca Mermelstein.  The court reporter appeared at 2:20 pm.  Another man, presumably the bailiff was sitting behind a computer in front of the judge’s bench.  Judge Fox appeared at 2:30 pm.  Everyone was instructed to rise, but I intentionally did not do so.</p>
<p>The judge took another case.  During this case, a court official gave me a financial form requesting my assets and income.  I refused to enter any information at all, including even my name.  I do have a Fifth Amendment right not to provide information that might be used against me.  The case being arraigned was quite interesting.  A woman plead guilty to purchasing 100 pounds of heroin from undercover police who were entrapping her to commit a crime.  The judge informed her that she could go to prison for up to 40 years and be fined up to $2 million.</p>
<p>Then started the inquisition.  The judge asked the woman many questions without informing her of her right to remain silent.  Was she aware of what she was doing?  Was she mentally competent?  Had she been previously convicted of drug use?  What illicit drugs has she used?  How long since she has used any?  What drug was the last use?  Does she understand what is going on?  etc, etc.</p>
<p>One of the questions was particularly interesting. Did she know that she was doing wrong?  He did not ask her if she knew that she was breaking the law?  Thus he inflicted moral, rather than legal, guilt.  The woman mechanically answered as expected to all the questions.  Her lawyer, who was sitting next to her approved of all of her answers.</p>
<p>Why did she, or her lawyer permit her to, plead guilty and give the desired response to these questions?  It did not appear likely that a plea bargain had been struck, since the prosecution had first hand information from the police, and the defendant appeared to have no defense.  The prosecuting attorney admitted that she had extensive irrefutable evidence.  Perhaps the defendant was going to be a prosecution witness against her accomplices for a reduced sentence.</p>
<p>Several things about this arraignment are bothersome:</p>
<ol>
<li>How reliable would her testimony be against others, if she was promised a reduced sentence to give evidence?</li>
<li>This woman had done nothing that should be legally wrong.  She purchased 100 pounds of poppy seed abstract.  Why do we put people in prison for buying flowers?</li>
<li>The real crime of entrapment was committed by the police.  It is they who should be the defendants.  They were selling the heroin.</li>
<li>Why is a U. S judge acting as an inquisitor?  Are we no longer pretending that our courts are courts of law, and that they are acting openly as courts of inquisition?</li>
</ol>
<p>At 3:00 pm, this arraignment was terminated, and another case was taken.  At 3:10 pm, my case was called.  Judge Fox denied my two motions to dismiss the case because the regulations were unconstitutional, and to order the government to return my confiscated property.  I pleaded not guilty, and asked for a jury trial and a habeas corpus hearing.  I learned that Magistrate Judge Debra Freeman issued my arrest warrant, that Magistrate Judge Frank Maas officiated at my hearing of June 14, and that Magistrate Judge Henry Pitman would be the presiding judge at my trial.  The hearing ended at 3:20 pm.</p>
<p>After the hearing, I went to the Criminal Court of Manhattan where I recovered the $210.00 the court owed me for three years.  Also I received a copy of the psychiatric exam of June 4, 2010.  However it would not give me a voucher to reclaim my confiscated property, which included my car keys, cell phone, pants, sweater, cap, and sneakers, among other items.  It took from 3:55 pm until 4:33 pm to accomplish this.</p>
<p><strong>2. Other FIJA Demonstrations</strong></p>
<p>Other FIJA distributions occur regularly at the Montgomery County, PA, Courthouse.   A FIJA distribution is planned at the U. S. District Courthouse in Tampa, FL for July 22, 2010.  I have no report for these distributions.  If the organizers will send me summaries, I will pass them on to the Tyranny Fighters E-mail list.  These need be only a few sentences giving the date, location, time period, number of participants, and number of pamphlets distributed.  If there is interaction with the authorities, of course report that also.</p>

			<content:encoded><![CDATA[<p>Well, I&#8217;ve just completed my first assignment for my <a href="http://c4ss.org/stateless-university">Stateless University</a> Anarchism 101 course.  So far I&#8217;m having a great time taking the class.  After reading the first few chapters of <a href="http://libertyactivism.info/wiki/The_Market_for_Liberty">The Market for Liberty</a> we were asked to compose an essay based on the topic, &#8220;What is aggression?  How can we distinguish between aggression and other kinds of undesirable influence?&#8221;  What follows is my essay, feedback is welcomed:</p>

How can we distinguish between aggression and other kinds of undesirable influence?</p>
<p>Aggression is usually defined as “the initiation of force”.  Usually that force is used to make a person do something against their will.  Personally, the definition seems a bit vague to me.  There are many types of force, both mental and physical.  In The Market for Liberty, even the Tannenhills hedge their bets with this sufficiently wishy-washy statement, “Many pressures may be brought to bear on a man, but unless he is compelled by physical force (or threat of force, or substitute for force) to act against his will he still has the freedom to make his own choices.”</p>
<p>What constitutes a “substitute for force”?  How can we distinguish between aggression and other kinds of undesirable influence?  If I convince you that I’m from a wealthy Nigerian family and manage to defraud you of some money, did I aggress against you?  If I put landmines in my front yard and you happen to step off the sidewalk and blow your leg off, did I aggress against you?  I didn’t use physical force to make you give me the money.  I didn’t use physical force make you step on my property.  How do you handle these situations?</p>
<p>This is where people usually begin making specific adaptations for each scenario.  They may say, “fraud constitutes a substitute for force and therefore in your first example you aggressed against me”.  Likewise they may say, “having my leg blown off was a disproportionate response to my fleeting trespass and therefore you aggressed against me in your second scenario.”  In the real world, I don’t think this question of “What is aggression?” would be that difficult to answer.  It seems to me that the main reason people are so worried about determining what constitutes aggression is because they are looking to respond with force.  If you don’t limit yourself to responses that only involve force you don’t need to worry as much about what constitutes aggression.  In many cases a response that doesn’t involve force actually works better, such as making people aware of common scams and people who commit fraud, or building a fence between yourself and your dangerous neighbor.</p>
<p>When I propose this to people, I usually get the response, “Well what about the sociopath who starts shooting people?”  That is a VERY CLEAR case of aggression.  It doesn&#8217;t get much clearer than that.  The problems that warrant great effort determining what is aggression can usually be solved through non-forceful means, thus negating the need to determine if they were clear examples of aggression.  The problems that seem to have no other solutions other than a response of force are usually clear cut cases of aggression.  If you expand your arsenal to include non-forceful methods of influence it mitigates much of the minutia involved in determining, “What is aggression?”</p></blockquote>

<blockquote><p>THE DEPARTMENT of Homeland Security seems to believe that national security requires the government to seize photographers&#8217; memory cards on public streets.A federal lawsuit filed by the New York Civil Liberties Union (NYCLU) in April may change their minds.</p>
<p>The plaintiff is Antonio Musumeci, a New Jersey software programmer and blogger who on November 9, 2009, filmed the arrest of an activist advocating jury nullification in a public plaza outside a federal courthouse in Manhattan. Musumeci was then arrested, detained, and ticketed, and an employee of the Federal Protective Service (a sub-agency of Homeland Security) confiscated Musumeci&#8217;s memory card.</p>
<p>Musumeci was arrested under a law that restricts photography on federal property. But the law explicitly allows photography in &#8220;building entrances, lobbies, foyers, corridors, or auditoriums for news purposes.&#8221; The statute also says public warning must be posted on federal property where photography is prohibited, which was not the case in the plaza where Musumeci was arrested. As the NYCLU notes, photography restrictions are applied inconsistently in different areas outside federal courthouses.</p>
<p>The charge against Musumeci was dismissed in March. Musumeci is taking the government to court to seek &#8220;declaratory and injunctive relief that will allow him to film and take photographs in public areas outside federal buildings where pedestrians have unrestricted access, as well as compensatory damages for his unlawful arrest.&#8221;</p>
<p>Donna Lieberman, executive director of the NYCLU, told the New York Daily News</p>
<p>she hopes the case establishes that &#8220;people have a clear right to use cameras in public places without being hassled and arrested by federal agents or police.&#8221;</p></blockquote>

<p>Court action</p>
<p>I still have not been able to recover all of my property from the arrest of May 25, 2010 when I was imprisoned in Riker’s Island prison.  I have sent requests to judges of both the Criminal Court of Manhattan and the District Magistrate Office of the the U. S. District Court of the Southern District of<br />
New York to issue orders to their respective property control offices to release my property.  The Criminal court of Manhattan has informed me that the $210.00 and psychiatric report are available for me to claim at my convenience in the Clerk of Court’s office.</p>
<p>I have a hearing on July 20, 2010, in front of a magistrate in the U. S. District Court S. D. N. Y. to plead in the case involving the arrest by federal marshals for failing to pay previous fines.  I have submitted a brief pointing out that the citations are for unconstitutional arrests and supported the claim with three U. S. Supreme Court decisions.  Hopefully, but not likely, the magistrate will dismiss the complaints at this time.<span id="more-5300"></span></p>
<p>In the Homeland Security civil suit in the U. S. District Court S. D. N. Y. all the named defendants have been served with summons.  Lawyers for most of the defendants have filed an appearance with the court.  The lawyers defending the various defendants are:</p>
<ul>
<li>U. S. Attorney for all U. S. government actors (Homeland Security, Central</li>
<li>Violations Bureau).</li>
<li>Corporation Counsel for the City of New York for the NY City Fire Department.</li>
<li>Kaufman Borgeest &amp; Ryan LLP for St. Vincent’s Catholic Hospital.</li>
<li>MARTIN CLEARWATER &amp; BELL for the NY Downtown Hospital.</li>
<li>No-one has made an appearance for Bellevue Hospital, but it may be a city hospital and be represented by the Corporation Counsel for the City of New York.</li>
</ul>
<p>Both of the represented hospitals have claimed that they cannot be sued: St. Vincent’s, because it has filed for bankruptcy; and NY Downtown Hospital, because it claims it is not a state actor and therefore immune from suit under 42 U. S. C. 1983.  I have challenged both claims.</p>
<p>Publicity</p>
<p>I have had long radio interviews with “Freedom Frenzy” on Republic Broadcasting Network July 5 and “Liberty News Radio” on July 8.  The “American Juror,” published by the American Jury Institute (FIJA) published my Progress Report of the Riker’s Island arrest in full.  I am sure that there were many other reports of our activities on the web, but they did not include personal interviews.  Thanks to everyone for the publicity.  Publicity is the name of the game.  It is true.  I am a publicity hound.</p>
<p>Many of you on the BCC Tyranny Fighters list are news outlets.  I suggest that you would have higher input if you were listed on the open list.  For those of you that wish to be on the open list, please notify me, and I will make the change.</p>
<p>Report from George Donnelly</p>
<p>George Donnelly was arrested at the U. S. District Courthouse in Allentown, PA on May 11, 2010.  He was charged with assault and placed under house arrest waiting for trial.  George sent the following report on July 9, 2010:</p>
<p>“Since June 22 I no longer have the ankle monitor and can travel the lower 48 states without requesting permission.</p>
<p>Paul Hetznecker is representing me. The charges are violations of <a href="http://www.law.cornell.edu/uscode/html/uscode18/usc_sec_18_00000113----000-.html">this</a> AND <a href="http://edocket.access.gpo.gov/cfr_2009/julqtr/41cfr102-74.385.htm">this</a> AND <a href="http://edocket.access.gpo.gov/cfr_2009/julqtr/41cfr102-74.390.htm">this</a>. You can google me and there is an article on libertapedia.org with the full/formal charges. The trial is scheduled for Aug 26, a bench trial in front of the same magistrate again. No jury. Just today Paul received their discovery. I will examine it soon with him.</p>
<p>I think around 150 people have raised a little over $6,000. I am very grateful for contributions as this as been a financial disaster for my family. Not only the costs of defending myself have been highly inconvenient, but also the fact that I had to make arrangements for us to continue renting a house here, instead of moving up to New Hampshire as we planned. There is no rent cost for us to live on our own land in New Hampshire.</p>
<p>I am very grateful for any donations or pitches.</p>
<p>I have a lot to say but am not supposed to be talking at all really. The most important thing is to remain firm in our convictions, to not feel anger, to not seek retribution but to continue righteously on.”</p>
<p>Future schedule</p>
<p>I will be in Portland, OR, with my wife from July 14–19.  I had hoped to distribute FIJA literature at the U. S. District Courthouse in Portland, but my wife said no because we are on vacation.  She is more persuasive than the United States courts.  Therefore, I will not be demonstrating in Portland. Sigh!</p>
