PROGRESS REPORT 7/26/10

1. Purpose of this memo

Here are my thoughts on the state of the nation and possible future plans for our movement. I am requesting your input on these ideas. Please let me know your thoughts.

2. Government failure

We have a huge prison population, huge debt, huge unemployment, unsuccessful lengthy wars, and bad foreign policy.

We are the number one prison state in the world. With less than 5% of the world’s population, we have 25% of the world’s prisoners. We are filling our prisons with people who own plants, vegetables, and flowers. Our prisons are hellholes.

We are in an economic collapse. The government gave over $1 trillion to the people responsible for the collapse. The government continues to pass legislation that cannot be financed. Our national debt is $13 trillion (about 90% of GDP and growing). The unemployment rate is at 9%.

Our government failed to cope with the environmental disasters caused by hurricane Katrina in New Orleans and the Gulf of Mexico oil spill by British Petroleum.

We are engaged in two lengthy and costly wars. We are sending our young adults to Iraq and Afghanistan to be killed, thus saving Osama Bin Laden the inconvenience of having to come to the U. S. for the killing. Our troops are demoralized because we are not supporting them sufficiently. In Iraq there have been more military deaths from suicide than from military action.

Our foreign policy is insane. We are catering to our enemies (Iran in particular) and alienating our allies. Israel is our staunchest and most reliable ally.

It is the frontline defense against Islamic expansion into Europe. However the Obama administration is going out of its way to alienate the Israelis. Turkey is a member of NATO and was the only Islamic country on good terms with Israel. It has now turned away from us and is siding with the other Islamic countries against us. It was responsible for the attempt to break Israel’s blockade of Gaza. North Korea and Iran snub their noses at us.
3. Judicial failure

Our courts are no longer courts of law, but are courts of inquisition. They openly ignore our Constitution. In my own experience with the courts, the U. S. District Court of the Southern District of New York denied me a trial and found judgment against me based on “irrefutable” video evidence which was tampered by the police. It disagrees with the police deposition of the facts.

The courts are prosecuting me for exercising my First Amendment right of free speech and my Fifth Amendment right to remain silent. The Sixth Amendment to the U. S. Constitution states:

“In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed;”

However the federal prosecutor wants to deny me a jury trial for distribution of pamphlets outside the U.S. District Court for the Southern District of New York. Furthermore the court hearing for my arrest in Springfield, MA, has been assigned to the U. S. District Court in Boston, MA. I wonder why it was not assigned to Hawaii or Alaska to inconvenience me further.

4. Political failure

The general population has given up on the government. Only about 30% of eligible voters actually vote. New political parties are forming or growing. The Tea Party movement of the last couple of years is an indicator of this. Also the Libertarian and other minor parties are growing in membership, as are anarchist groups.

In addition completely alienated groups are being formed and growing. The Southern Poverty Law Center (SPLC) monitors these groups. There are now 932 of these groups in the U. S. Approximately 1/4 of these groups hate ethnic groups, approximately 1/4 oppose illegal immigrants, and approximately 1/2 are
Patriot groups. According to the SPLC:

“The number of hate groups in America has been going up for years, rising 54% between 2000 and 2008 and driven largely by an angry backlash against non-white immigration and, starting in the last year of that period, the economic meltdown and the climb to power of an African American president.“

But last year, as noted in the SPLC’s August report:

“The Second Wave: Return of the Militias,” a dramatic resurgence in the Patriot movement and its paramilitary wing, the militias, began. Now, the latest SPLC count finds that an astonishing 363 new Patriot groups appeared in 2009, with the totals going from 149 groups (including 42 militias) to 512 (127 of them militias) — a 244% jump.”

5. Tyranny Fighters program proposals

It is becoming clear that our government has failed us. The American people have given up hope of fixing the problem through the two party system or the courts, at least in the short term. If the economy worsens there will be no long term. Unless something positive is done there will be armed rebellion.

My view is that the best hope to restore freedom is through the juries. That is why I started passing out FIJA information at U. S. District Courthouses and asked you to join in this activity. A few thousand people are active in one way or another. There are 264 on the Tyranny Fighters’ E-mail list. But we must expand our operation. I see two ways to do this:

  1. Expand to include other causes and the organizations that support those causes. The constitutional causes that come to mind are:
    1. 2nd Amendment rights supporting gun ownership. Gun ownership seem to drive some people crazy, because of the excessive reporting of their misuse. However there is no other practical way to hunt or to protect yourself. Guns cause fewer deaths than motor vehicles, swimming pools, cigarettes, alcohol, overeating, or hospital negligence.
    2. End drug prohibition. The current laws violate the right of privacy guaranteed by the 9th Amendment. Putting people in prison for owning plants, vegetables, and flowers is the dumbest thing since the Salem witch trials.
    3. Abolish the income tax, which is robbery and makes criminals of all of us. The worst income tax evaders are illegal immigrants and those involved in selling illegal drugs and prostitution, because these people have no legal income to report. In addition anyone involved in cash transactions or bartering. Income tax evasion is the chief source of monetary crime in the United States.
    4. I believe we should avoid other issues, such as abortion, death penalty, environmental, foreign policy, and immigration. These are important issues, and all of us have strong views on them, but our views are not all the same. Furthermore they are not primarily constitutional issues. These issues will divide us, and we will lose sight of the main goal, which is to regain our freedom. Of course any individual or other group is free to advocate these issues in front of courthouses or anywhere else, even in our presence. We do not oppose free speech for others.
  2. I think that, in addition to FIJA literature, we should distribute literature for the Libertarian and Constitution political parties, as well as for gun rights, abolition of drug prohibition, and abolition of the income tax.

6. FIJA Demonstrations

In addition to the FIJA demonstrations that I am organizing in the northeast, there are demonstrations in several cities in southern Florida organized by Jim Cox, as well as at the county courthouse in Montgomery County, PA organized by the Libertarian Party of PA. I believe that other demonstrations may be occurring in New Hampshire and the San Diego, CA area, but I have no details.

7. Financial needs

Our FIJA outreach program has ballooned beyond my wildest expectations. One problem that this poses is financial. The costs are now exceeding our
financial capabilities. You can help alleviate this problem by making donations to the following:
