		<description>How reckless? Such that they are directly putting others in harms way. Otherwise if the road were privately owned whatever level they choose. A guy swerving in and out of traffic is a direct threat... a guy swerving on an empty road at 3am is not.

 We have laws about placing others in directly and explicit danger. Drunk driving laws and enforcement as we currently have are a guilty before innocent, victimless crime.</description>

 So reckless driving presents a clear and present danger to other people?  There are several shades of gray in there.  How reckless?  As far as the owners of a road taking preventative measures how preventative can they be? I'm willing to bet that you agree with me that if a private individual possesses a road they can take any preventative measures they wish.  That being said,  the state currently has a monopoly on roads, how preventative should their measures be?</description>
